Eligibility Requirements

To use this Service and submit a vehicle for evaluation, you must meet the following requirements:

• You must be at least 18 years of age or the age of majority in your jurisdiction
• You must be the legal owner of the vehicle you are submitting
• You must be authorized to sell the vehicle
• You must have the legal capacity to enter into a binding contract
• You must not be prohibited from using the Service under applicable law
• You must provide accurate and truthful information

By using this Service, you represent and warrant that you meet all of these eligibility requirements. If you do not meet these requirements, you must not use the Service.

Vehicle Submission

When you submit your vehicle information through our platform, you agree to the following:

Accuracy of Information

• All information provided about your vehicle is accurate, complete, and truthful
• You will promptly update any information that becomes inaccurate or incomplete
• You certify that the VIN, mileage, condition, and all other details are correct
• You acknowledge that false or misleading information may result in termination of your submission
• You understand that material misrepresentations may have legal consequences

Authorization and Permissions

• You grant us permission to review, evaluate, and inspect your vehicle
• You authorize us to verify vehicle information through third-party services
• You agree to respond to our inquiries in a timely and professional manner
• You understand that submission does not guarantee an offer or purchase
• You acknowledge that we reserve the right to decline any vehicle for any reason

Duplicate Submissions

We employ duplicate detection to prevent spam and ensure efficient processing. You agree not to submit the same vehicle multiple times within 30 days. Duplicate submissions may be automatically rejected.

Photos and Videos

By uploading photos and videos of your vehicle, you represent, warrant, and agree that:

• You own all rights, including copyright, to the uploaded materials
• The materials do not infringe on any third-party rights
• You grant us a non-exclusive, worldwide license to use these materials for evaluation purposes
• The materials accurately represent the current condition of your vehicle
• The materials do not contain any prohibited, offensive, or inappropriate content
• We will keep these materials confidential and use them solely for evaluation purposes
• We may retain these materials for our records as outlined in our Privacy Policy

Evaluation Process and Offers

You understand and agree to the following regarding our evaluation process:

• We will review your submission within a reasonable timeframe
• We may request additional information, photos, or videos
• We may schedule an in-person inspection of the vehicle
• Any offer made is contingent upon verification of information and vehicle condition
• Offers may be subject to expiration dates and market conditions
• We reserve the right to withdraw or modify an offer at any time before acceptance
• Final purchase price may be adjusted based on in-person inspection findings

No Obligation

Submitting your vehicle information does not create any obligation for either party. You are not obligated to accept any offer we make, and we are not obligated to make an offer on any vehicle. Both parties retain the right to decline to proceed with a transaction at any time prior to the completion of the sale.

Our evaluation and any offer made is an invitation to negotiate, not a binding commitment to purchase.

Prohibited Conduct

You agree NOT to engage in any of the following prohibited activities:

• Submit false, misleading, or inaccurate information about any vehicle
• Submit information about vehicles you do not own or are not authorized to sell
• Use automated systems, bots, or scripts to access or submit information to the Service
• Attempt to circumvent any security measures, rate limits, or access controls
• Submit spam, malicious content, or content containing viruses or harmful code
• Impersonate any person or entity or misrepresent your affiliation
• Harvest or collect information about other users
• Interfere with or disrupt the Service or servers
• Use the Service for any illegal purpose or in violation of any laws
• Attempt to gain unauthorized access to any part of the Service
• Reverse engineer, decompile, or disassemble any part of the Service
• Remove or modify any copyright, trademark, or proprietary notices

Violation of these prohibitions may result in immediate termination of your access to the Service and may subject you to civil and criminal liability.

Security and Fraud Prevention

The AutoBuyer name, logo, and all related names, logos, product and service names, designs, and slogans are trademarks of AutoBuyer. You may not use these marks without our prior written permission.

Disclaimer of Warranties

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

• Implied warranties of merchantability, fitness for a particular purpose, or non-infringement
• Warranties regarding the accuracy, reliability, or completeness of any content or information
• Warranties that the Service will be uninterrupted, secure, or error-free
• Warranties regarding the results obtained from using the Service

We do not warrant that defects will be corrected, or that the Service is free of viruses or other harmful components. Your use of the Service is at your sole risk.

Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, AUTOBUYER SHALL NOT BE LIABLE FOR:

• Any indirect, incidental, special, consequential, or punitive damages
• Loss of profits, revenue, data, or use
• Loss of business opportunity or goodwill
• Costs of procurement of substitute services
• Any damages arising from your use of or inability to use the Service
• Any damages resulting from unauthorized access to your information
• Any damages arising from errors, omissions, interruptions, or delays in the Service

IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU FOR ALL DAMAGES EXCEED THE AMOUNT PAID BY YOU, IF ANY, FOR ACCESSING THE SERVICE, OR ONE HUNDRED DOLLARS ($100), WHICHEVER IS GREATER.

Some jurisdictions do not allow the exclusion or limitation of certain damages, so some of the above limitations may not apply to you.

Indemnification

You agree to indemnify, defend, and hold harmless AutoBuyer, its officers, directors, employees, agents, and affiliates from any claims, liabilities, damages, losses, costs, or expenses (including reasonable attorneys' fees) arising from: (a) your use of the Service; (b) your violation of these Terms of Use; (c) your violation of any third-party rights; (d) any false or misleading information you provide; or (e) your violation of any applicable laws or regulations.

Dispute Resolution and Governing Law

These Terms of Use shall be governed by and construed in accordance with the laws of the state where AutoBuyer is headquartered, without regard to its conflict of law provisions.

Any disputes arising from these Terms of Use or your use of the Service shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association, except that either party may seek injunctive or equitable relief in court to prevent infringement of intellectual property rights or confidentiality obligations.

You agree to waive any right to a jury trial and to participate in any class action lawsuit or class-wide arbitration.

Modifications to Terms

We reserve the right to modify these Terms of Use at any time. We will notify you of material changes by posting the updated terms on this page and updating the "Last Updated" date. Your continued use of the Service after such modifications constitutes your acceptance of the updated terms.

Termination

We reserve the right to terminate or suspend your access to the Service immediately, without prior notice or liability, for any reason, including but not limited to breach of these Terms of Use, suspected fraud, or any conduct that we deem harmful to the Service, other users, or third parties.

Upon termination, your right to use the Service will immediately cease. All provisions of these Terms of Use that by their nature should survive termination shall survive, including ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

Severability

These Terms of Use, together with our Privacy Policy, constitute the entire agreement between you and AutoBuyer regarding the use of the Service and supersede all prior agreements and understandings, whether written or oral, relating to the subject matter herein.
